WVA presented at two events at the Monongalia County Technical Education Center (MTEC). During these events, the Advocate spoke with students and teachers about the Workforce Innovation and Opportunity Act (WIOA) and that WIOA required the WV Division of Rehabilitation Services (WVDRS) to be involved much earlier in transition planning. Participants at the events included students with disabilities and teachers/aides. <p><p>WVA did a presentation for the Elkins Life Skills Day Habilitation Program at the request of their staff. The Advocate gave a brief summary/description of each of WVAs grants, including CAP, and the services we provide under those grants. Participants included people with intellectual/developmental disabilities and program staff. <p><p>WVA gave presentations at the Northern WV Center for Independent Living (CIL) offices in both Morgantown and Elkins to staff and individuals with disabilities, and at a picnic sponsored jointly by the Center and the Friendship Room, a peer run drop in center for individuals with mental illness in Morgantown. At the CIL offices, the Advocate reviewed each of WVAs federals grants, including CAP, and our Priorities and Objectives (P&Os). A copy of our P&Os was distributed as well. <p><p>WVA gave a presentation to the Lewisburg parents support group at the request of the groups leader. The Advocate discussed WVAs intake process, each of WVAs grants, including CAP, explaining some of the changes due to WIOA including that WVDRS must be involved earlier in students transition planning, including being an active member of their childs Individualized Education Program (IEP) team. Attendees included parents of students with disabilities. <p><p>WVA gave a presentation to the PACE group at the Disability Action Center. Participants included individuals with intellectual/developmental disabilities and a person with a traumatic brain injury. The Advocate reviewed each of WVAs federals grants, including CAP, and our Priorities and Objectives (P&Os). A copy of our P&Os was distributed as well. <p><p>WVA provided a presentation at a housing location operated by the Charleston Kanawha Housing Authority serving people with disabilities and the elderly. The session was primarily geared toward general information about WVA and our federal programs. An attendee asked a lot of questions about employment, which resulted in the Advocate providing more detailed information about CAP. <p><p>As a result of reaching out to collect information for an article in WVAs Advocare newsletter (described elsewhere in this report), WVA was invited to give a presentation to WorkForce WV staff, which included veterans, at the office in Morgantown. The Advocate presented information on WVA, our P&A programs, focusing specifically on employment related issues that we can help to address. We discussed the responsibilities of WVDRS and how CAP can assist people who are experiencing problems with their services from th
C. Agency Outreach
Events where WVA staff provided outreach with CAP and other program funds either in person or by sending materials in FY 2016 included: An event at the Milton Rotary. Participants included nine Rotary members from the town of Milton, WV. Disability Day at the Legislature. The eighty people who attended included members of the Fair Shake Network (a self-advocacy network), twenty-five different organizations, WV Legislators and their staff, and people affiliated with any particular group. A presentation to thirty homeless individuals and staff at the Winter Freeze Shelter in Wheeling, WV. A presentation to students of the Ohio County Schools adult education program at the WV Northern Community College. Fifteen students and a teacher were present. A presentation at the Marian House, a peer run drop in center for individuals with mental illness in Wheeling. Six people with mental illness and staff were present. Deaf Awareness Day at the State Capitol. One hundred twenty people were present, including people who are deaf and their families, agencies serving people who are deaf, and WV Legislators and their staff. The annual One4All Disabilities Expo which is targeted to people with disabilities of all ages and their families/caregivers for the purpose of bringing resources and information together in one location. The annual Celebrating Connections conference which is for providers of services to young children. The annual transition event in the Parkersburg area which included over two hundred students with disabilities, families and teachers. The annual Social Workers conference which included social workers from around WV. The annual Celebrate Youth event including over 7,000 children and their families. Presentations at four housing locations operated by the Charleston Kanawha Housing Authority (not including the one described in the training narrative above) serving people with disabilities and the elderly. WVA attended a &quot;Veterans Stand Down&quot; event to reach out to homeless veterans. The Hands and Voices picnic, which included many people who are deaf. <p><p>In all of these events, we attempted to reach individuals we have not yet served as well as people from diverse ethnic and minority communities. WVA continues to look for ways to reach out to minority populations including in-person outreach. <p><p>WVA was invited to set up an outreach table at the annual Consumer Affairs Committee (CAC) conference. Seventy-two people attended this event. Regional CACs throughout the state support and advise the WVDRS and are comprised of various entities from local communities. The CACs work to empower people with disabilities in making informed choices and achieving equal opportunity, meaningful employment, independent living, and economic and social self-sufficiency. <p><p>At the end of FY 16, a new edition of our Advocare newsletter was created. WVA now has 819 Facebook Friends generating more activity than ever! According to WVAs latest Facebook page statistics, WVA reached an average of 3,652 people in the last month of the fiscal year. People and agencies who like our page are viewing and sharing many things we post on a regular basis. E. Information Disseminated About Your Agency By External Media Coverage
WVA purchased a full-page ad in the event booklet detailing the services we offer for the Celebrate Youth event sponsored by Youth Service Systems listed elsewhere in this report. This event was attended by over 7,000 people per the related article in the Wheeling News Register (http://www.theintelligencer.net/news/community/2016/08/thousands-attend-youth-services-systems-celebrate-youth-festival-at-wheeling-park/). Our invitation to participate in this event occurred because of our participation in another outreach event in that area of the state. <p><p>WVA was invited to take part in the WVU Center for Excellence in Disabilities (CED) Access for All television program, which aired in September 2016. During this half hour show, the Advocate explained each of the federal programs, including CAP. Access for All is aired on the Library Television Network (LTN). All shows on LTN are aired twenty times per month, available at 172 public libraries and on LTNs streaming video page. WVA continued to participate in the WV Statewide Independent Living Council (SILC) meetings. WVA attended three meetings in FY 2016. WVA is not a member of the SILC, but attends and participates in the meetings to keep informed and updated on the status of independent living services in WV. This allows WVA to maintain current information to provide to our Board, clients and staff as needed when issues arise that are pertinent to these services. WVA networked with members during each of the meetings to ensure they were aware of our services. Also in FY 2016, WVAs new Executive Director, Program Director and an Advocate met with the SILCs Executive Director to discuss potential collaboration between WVA and the SILC. In addition, when WVA was seeking input for our FY 2017 Priorities and Objectives (P&Os), the announcement was sent out to SILC members. The SILC then extended WVAs request for input to all members as well as their e-mail list. <p><p>WVA continues to participate as a member of the WV Statewide Rehabilitation Council (SRC). WVA attended four SRC meetings in FY 2016. In FY 2016, WVA followed the development of the five year WV State Unified Plan between the WVDRS, WV Department of Education Adult Education and WorkForce WV. The plan can be found at: http://workforcewv.org/images/files/PublicInfo/Unified_State_Plan_ICRUpdate3716pj.2.cover.pdf. Much emphasis was placed on serving transition-age youth per WIOA. The announcement seeking input for our FY 2017 P&Os was sent out to SRC members as well. SRC members then forwarded the request for input to other stakeholders. <p><p>During the summer of FY 2016, WVA was able to get two legal interns from the WVU College of Law. These interns learned about all of the Protection and Advocacy Programs, including CAP. They researched several areas of law and assisted in drafting publications which WVA will use for training new staff. The publications include a PowerPoint about unauthorized practice of law, as well as information about service animals and the ADA. <p><p>WVAs Program Director attended Rehabilitation Services Administrations (RSA) 17th Annual Project Directors Conference in Arlington, VA in October 2015. <p><p>WVA staff also monitor NDRNs CAP and Return to Work listservs and share pertinent information and resources with other agency staff. In August 2016, NDRN staff came to WV to train all WVA Advocates and Attorneys on CAP. This was a comprehensive two-day training about CAP and how to handle CAP cases. WVA staff also participated in numerous NDRN CAP and WIOA webinars and teleconferences throughout the year as well as NDRNs annual conference. <p><p>As a result of interaction with WVDRS counselors and branch managers, it has come to the attention of WVA that as of September 30, 2016, WVDRS has not provided information or training on regulations under WIOA to staff in their area. Part VI. Case Examples
Case Examples
A CAP client requested WVAs assistance in order to receive additional training and education to become job ready through the WV Division of Rehabilitation Services (WVDRS). The client desired WVDRS to add training, college or certificate level to her Individual Plan for Employment (IPE) because she had not been successful with obtaining employment during the three years they had provided her with services. WVDRS had a practice of deeming clients with college degrees as employable, and for this reason would not provide education as a service in the IPEs of clients who, at the time of application to WVDRS, had college degrees. This client had a bachelors degree. WVAs review of the clients WVDRS records identified a number of significant problems, including that, soon after the clients IPE was developed by WVDRS, her vision had declined so significantly and she could no longer pursue the goal in her IPE. WVA attended a meeting with the client, her WVDRS counselor and other WVDRS representatives to address the clients concern related to her IPE and stalled services. WVA presented facts from the clients WVDRS record including: the client could not pursue the goal in her IPE due to significant loss of vision documented in her records; WVDRS efforts to provide job leads, job placement assistance and the clients submission of numerous applications for jobs had not resulted in one interview for the client; and that, although the client had requested modifications to her IPE, WVDRS would not modify her IPE. WVA requested that WVDRS provide modifications to the clients IPE including a new employment goal, and certificate or college level training to prepare the client for a new career in the nursing field that would build on her years of successful employment. The outcome of this meeting was that WVDRS provided a written decision denying WVAs request for the modifications to the IPE. WVA then filed an appeal on behalf of the client, requesting an administrative review. WVDRS response to the appeal reversed their original decision. They agreed to provide the client with modifications to her IPE, a new employment goal, and a number of additional services. However, WVA negotiated with WVDRS because the remedy proposed by them also contained incorrect information and several recommendations for services that the client and WVA objected to and that the client did not need. WVAs negotiations with WVDRS resulted in very satisfactory outcomes for the client. WVDRS agreed to: provide a new IPE goal; college training to achieve the IPE goal; and an extensive list of services that they agreed the client was in need of to attain her new IPE goal. In addition, throughout this Service Request, WVA provided the client with information regarding the WVDRS policies and procedures, and her rights and responsibilities as a client of WVDRS. <p><p>A CAP client asked WVA to negotiate with WVDRS to waive their requirement of a credit score of 600, which was one o
